This Beta Participation Agreement ("Agreement") is a legally binding contract between you ("Tester") and Balanced Security ("Developer"). By clicking "I Agree," checking the agreement box during account registration, or otherwise accessing the beta version of the BalancedSec Academy CISSP prep web platform ("Platform"), Tester agrees to be bound by the terms of this Agreement.
1. Purpose & Beta Status
Tester acknowledges that the Platform is currently in a beta testing phase. The Platform is provided on an "AS IS" and "AS AVAILABLE" basis for the purpose of evaluation, bug testing, and feedback. Tester understands that the Platform may contain errors, bugs, or inaccuracies and may not perform as smoothly as a final, commercially released version.
2. Application, Review, and One Account per Person
- Application: The information Tester provides when applying for or registering a beta account, including name, email address, and answers to the beta application questions, is part of this Agreement. Tester represents that this information is truthful and complete.
- Review at Developer's Discretion: Developer reserves the right to review every beta account and, at its sole discretion and at any time, to accept or reject it. Access may be granted before this review is complete. If Developer rejects an account, Tester's access to the Platform ends and any remaining Individual Testing Period is forfeited.
- One Account: Each person may hold one beta account. Additional accounts held by, or on behalf of, the same person may be closed without notice.
- Basis for Rejection: Developer may reject an account for any reason or no reason, including that the application information appears incomplete, untruthful, or inconsistent with the purpose of the beta described in Section 1, or that Tester does not appear to be actively preparing for the CISSP examination.
3. Feedback Requirements & Usage Analytics
- Active Feedback: Tester agrees to actively use the Platform and to complete the feedback surveys the Platform presents during the beta (the "Surveys") before the conclusion of the beta testing period.
- Usage Analytics: Tester acknowledges and agrees that usage data is automatically tracked and collected on the Platform ("Usage Analytics"). Developer uses Usage Analytics to understand how the Platform is used, to improve it, and to detect misuse.
4. Compensation & Individual Testing Period
In consideration for Tester's participation in the beta, Developer will grant Tester free, non-transferable access to the Platform's premium ("Pro") tier for a period of thirty (30) days beginning on Tester's date of account registration (the "Individual Testing Period"). This grant is subject to review under Section 2. This thirty (30) day premium access constitutes full, fair, and complete compensation for Tester's participation. At the end of the Individual Testing Period, access automatically reverts to the Platform's free tier. Tester's obligation to complete the Surveys is set forth in Section 3.
5. Proprietary Content & Non-Distribution
The Platform contains highly proprietary practice questions, exam simulations, explanations, study guides, CISSP Preparation Book, and test methodologies ("Proprietary Content").
- Tester shall not copy, screenshot, video record, scrape, or save any Proprietary Content.
- Tester shall not share, distribute, or publish any Proprietary Content to any third party, in any forum, or by any means.
- Any violation of this section will result in immediate termination of access, revocation of post-launch rewards, and potential legal liability for intellectual property infringement.
6. Promotional Rights & Testimonials
Tester grants Developer a worldwide, royalty-free, perpetual, and irrevocable license to use, reproduce, and display the written text answers provided by Tester in the Surveys (including "overall impressions," "most valuable features," and "referral quotes") for marketing, advertising, and promotional purposes.
- Developer may publish these testimonials alongside Tester’s first name, last initial, and professional title/certifications (e.g., "John D., Security Analyst").
- Developer explicitly agrees to omit Tester's email address from all public marketing materials, and to omit Tester's full last name unless Tester explicitly grants its use.
7. Data Security & Privacy (CISSP Platform Specific)
Developer recognizes that Tester is a security professional and values data privacy.
- Data Minimization: Developer will only collect information necessary to operate the Platform, process the Surveys, analyze usage, and detect misuse.
- Usage Data: Tester's usage data are treated as confidential. They will not be sold or shared with third parties. Developer reviews them to improve the question bank and the Platform and to detect misuse.
- Data Protection: Developer implements industry-standard administrative and technical safeguards to protect Tester's account information and survey responses from unauthorized access.
8. Limitation of Liability
In no event shall Developer be liable to Tester or any third party for any loss of data, loss of profits, or any direct, indirect, incidental, or consequential damages arising out of the use of or inability to use the Platform, even if Developer has been advised of the possibility of such damages.
9. Termination
Developer reserves the right to terminate this Agreement, the beta testing period, or Tester's access to the Platform at any time, with or without cause, and without prior notice. Sections 5, 6, 7, and 8 shall survive any termination of this Agreement.
